Section 3 of the IT Act 2000 recognises digital signatures created using asymmetric cryptosystem and hash function — this is the basis of the Signing DSC issued by Licensed Certifying Authorities. Section 3A inserted by the IT Amendment Act 2008 recognises electronic signatures, including the Aadhaar-OTP-based eSign service. eSign is a one-time short-validity signing certificate (typically 30 minutes) issued through CCA-licensed eSign service providers — it has no encryption capability and cannot be used as an Encryption DSC.
Encryption DSCs are issued by Licensed CAs with validity of 1 year, 2 years or 3 years. Two-year validity is the market standard. Beyond 3 years renewal is mandatory — the CA cannot issue a longer validity under the Certifying Authorities (Procedures) Rules read with the CPS of the licensed CA. Renewal at expiry is required to continue using the certificate for tendering.
