Quick Answer

What is the legal distinction between a Signing DSC and an Encryption DSC in Koyambedu Flower Market, Chennai?

A Signing DSC and an Encryption DSC are two structurally different X.509 key-pairs issued under different Key Usage extensions of RFC 5280. The Signing DSC carries the digitalSignature and nonRepudiation key-usage bits and is governed by Section 3 of the Information Technology Act 2000 — the private key signs a hash of the document, the public key verifies. The Encryption DSC carries the keyEncipherment and dataEncipherment bits — the sender encrypts a symmetric session key with the recipient's public key, the recipient decrypts with their private key. The two purposes are mutually exclusive at the certificate level under the CCA Identity Verification Guidelines 2021.

People Also Ask — Encryption DSC in Koyambedu Flower Market
What is an Encryption DSC and how is it different from a Signing DSC?
An Encryption DSC is a Class 3 Digital Signature Certificate carrying keyEncipherment and dataEncipherment Key Usage extensions used to receive encrypted documents. A Signing DSC carries digitalSignature and nonRepudiation extensions used to sign documents under Section 3 of the IT Act 2000. The two have entirely different cryptographic purposes — confidentiality versus authentication and non-repudiation — and Indian CAs issue them as separate certificates under CCA IVG 2021.
Why do e-Tender platforms require an Encryption DSC?
e-Tender platforms operate on sealed-bid public-key cryptography. Bidders encrypt bid documents with the Tender Inviting Authority's Encryption DSC public key so that no one — not even portal administrators — can read bids before official tender opening. Without an Encryption DSC the technical sealed-bid integrity required under GFR 2017 cannot be achieved, and the bid upload is rejected by CPP Portal, GePNIC and etenders.tn.gov.in.
Is an Encryption DSC required for GST or Income-Tax filings?
No. GST returns on gst.gov.in and Income-Tax e-filing on incometax.gov.in only require a Signing DSC. The portals verify the digital signature on returns under Rule 26 CGST Rules and Form 26 IT Rules using TLS transport encryption — no separate document-level encryption envelope is applied. An Encryption DSC adds no value for GST or Income-Tax.
How long is a Class 3 Encryption DSC valid?
Class 3 Encryption DSCs are issued with 1-year, 2-year or 3-year validity. Two years is the market standard. Beyond 3 years renewal is mandatory under the CCA-licensed CA's Certification Practice Statement. Koyambedu Flower Market clients are reminded 60 days before expiry to avoid mid-tender bid-decryption failure.
Can the same DSC be used for both signing and encryption?
No. Under RFC 5280 and CCA IVG 2021 these are issued as separate certificates with disjoint Key Usage extensions. Mixing the two functions on a single key-pair conflicts with non-repudiation and is not permitted by Indian Licensed CAs. Bidders use a dual-purpose token holding two distinct certificates — one Signing, one Encryption — bound to the same identity.
What happens to encrypted documents if the Encryption DSC USB token is lost?
Without key escrow, the encrypted documents become permanently inaccessible — which is acceptable for tendering where bid documents are time-bound. With key escrow at the CA, archived encrypted content can be recovered. Either way, immediate revocation is requested under Section 38 of the IT Act 2000 and a fresh Encryption DSC is issued for ongoing use.
How long is an Encryption DSC valid?

Encryption DSC validity is typically two years from issuance under standard Class 3 CCA-licensed CA terms. Renewal 60 days before expiry is recommended to prevent mid-tender bid-decryption complications. The FIPS 140-2 Level 2 USB token itself is reusable across multiple renewal cycles.

Can I renew Encryption DSC mid-tender?

Yes. The bidder's Encryption DSC expiry does not affect the TIA's decryption ability (TIA uses its own private key). However, renewing 60 days pre-expiry preserves audit-trail continuity under Section 65B(4) and avoids future evidentiary friction. ₹2000 standard renewal fee applies.

What is the CRL under Section 38-39 IT Act?

The Certificate Revocation List (CRL) is the public list maintained by each CCA-licensed Certifying Authority of all Digital Signature Certificates that have been suspended under Section 38 or revoked under Section 39 of the IT Act 2000. OCSP responder provides real-time certificate validity verification.

Is Combo DSC better than separate Signing and Encryption DSCs?

For active bidders, a Combo Sign+Encrypt token holding both certificates of the same signatory simplifies device management without breaching cryptographic key separation — each certificate retains its own private key inside the FIPS 140-2 token. For occasional users, separate single-purpose DSCs are often cheaper.

How does CPP Portal use the Encryption DSC?

The Central Public Procurement Portal auto-fetches the Tender Inviting Authority's Encryption DSC public key during bid-upload and encrypts the bid documents to that public key. The bidder's Encryption DSC then signs the encryption operation under sole-control attestation, completing the IT Act Section 35-39 chain.

What if my bid cannot be decrypted by the TIA?

If the TIA cannot decrypt the bid, the typical cause is encryption to the wrong TIA's public key during multi-tender bid preparation. Approach the receiving TIA with a Section 38(2)-style curable-defect representation, offer Section 65B(4) certification of bid preparation timing, and seek re-upload window.

Why encryption dsc matters for your business

Section 65B Admissibility in Court

Encrypted and signed bid documents handled with FilingPro-issued DSCs come with Section 65B(4) certificate-ready audit trail — admissible as evidence in tender disputes per the Supreme Court authority.

Sealed-Bid Tender Participation Enabled

With the Encryption DSC registered on CPP Portal and GePNIC, Chennai bidders can participate in any Government, PSU or defence sealed-bid tender under GFR 2017 procurement rules.

Confidentiality of Bid Documents Guaranteed

Bid documents are encrypted with the Tender Inviting Authority's Encryption DSC public key. No one — not the portal, not competitors — can read the bid until official opening. Chennai bidders' commercial terms remain confidential until the legally prescribed moment.

How the engagement runs end to end

Video Verification Recording

A live video verification call records the applicant reading out a CA-supplied verification phrase and showing the original PAN. The recording is retained as IVG 2021 audit evidence.

RA Verification & Certificate Generation

The CA's Registration Authority verifies the e-KYC and video evidence. The Class 3 Encryption certificate is generated by the CA and the key-pair is created inside the FIPS 140-2 USB token — Schedule II IT Act sole-control requirement satisfied.

Eligibility Assessment & Plan Selection

Tender platforms in scope, certificate validity (1/2/3-year), encryption-only or combo with Signing DSC, FIPS token level (L2 or L3) and number of applicants are scoped for the Chennai client. PAN, Aadhaar and organisation documents collected on WhatsApp.

What FilingPro brings to the engagement

Same-Day Class 3 Issuance

FIPS 140-2 Token Supplied

Every Encryption DSC ships on a FIPS 140-2 Level 2 USB cryptographic token — Watchdata ProxKey, ePass2003 or IDsign — with the key-pair generated inside the token under Schedule II IT Act 2000 sole-control requirements.

Glossary

Plain-English glossary for this service

Sealed Envelope Encryption

The cryptographic equivalent of a sealed tender envelope where the bid document is wrapped with the tender authority's public key at submission and remains undecryptable until the official bid opening event when the tender authority unwraps it using its private key. CPP Portal and GeM implement this through AES symmetric encryption of the bid content with the symmetric key itself wrapped using the recipient's RSA public key.

CPP Portal e-Tendering

Central Public Procurement Portal operated under Department of Expenditure for e-tendering by central government departments, public sector undertakings, and autonomous bodies. Uses bid encryption requiring bidder's organisational encryption DSC, signing DSC for digital signature on bid documents, and time-locked encryption ensuring bids cannot be opened before the scheduled opening time even by portal administrators.

GeM Bid Encryption

Government e-Marketplace's bid encryption mechanism for bids above prescribed threshold values. Uses the seller's organisational encryption certificate registered on GeM seller profile to wrap the financial bid component. Pre-defined bid window opens and closes at portal-controlled timestamps with bid opening only possible at the scheduled time by authorised buyer-side openers using the buyer's decryption keys.

ASBA Payment Encryption

Application Supported by Blocked Amount encryption framework used by Self Certified Syndicate Banks in IPO and FPO applications. Investor's bid details and PAN are encrypted using the registrar's public key to ensure confidentiality of subscription patterns until allotment. Built on the same X.509 PKI infrastructure as DSC, applies to retail and HNI investors equally, governed by SEBI ICDR Regulations.

RBI Online Encryption

Reserve Bank of India's online portal for regulatory return filing by banks, NBFCs, AD Bank category-I entities, and certain payment system operators. Requires encrypted submission of returns using RBI-published encryption certificate. Monthly XBRL returns under various RBI Master Directions and FEMA-related returns flow through this channel. Encryption is in addition to the signing DSC and not a substitute.

MCA Portal Upload Encryption

MCA21 portal encryption for sensitive document uploads such as Form MGT-7 annual return, Form AOC-4 financials, and Form DIR-3 KYC. Built on the same PKI framework as the signing requirement, additionally requires that the upload channel itself uses TLS 1.2 or higher. Self-signed certificates are rejected because MCA21 enforces certificate chain validation against CCA-licensed CAs.

GSTN ASP Encryption

Encryption between an Application Service Provider intermediary and GSTN's API gateway when bulk filing of GSTR-1, GSTR-3B, or GSTR-9 is routed through an ASP-GSP integration. The ASP's encryption certificate is registered on the taxpayer's GSTN profile and used to wrap the return data payload. ASP switch requires re-mapping of the new ASP's encryption certificate on GSTN before bulk filing can resume.

ICEGATE Customs Encryption

Indian Customs Electronic Commerce Gateway encryption for response messages back to importers and exporters such as assessed Bill of Entry, query messages, and Out of Charge orders. Requires registration of the user's encryption certificate separately from the signing certificate on the IEC holder profile. Without encryption certificate registration, ICEGATE response messages cannot be delivered causing container hold and demurrage.

Section 3A IT Act

Section 3A of the Information Technology Act 2000 introduced by 2008 amendment, providing legal recognition to electronic signatures using techniques notified by the Central Government in addition to digital signatures under Section 3. Practical relevance: it widens the legal acceptability of e-signatures beyond DSC, while DSCs continue to be the most robust form because they leverage CCA-licensed CA infrastructure for non-repudiation.

Section 65B BSA Evidence

Section 65B of the Bharatiya Sakshya Adhiniyam 2023 (formerly Section 65B of Indian Evidence Act 1872) governing admissibility of electronic records as evidence in court. A document digitally signed with a valid DSC carries strong evidentiary weight under Section 65B because the certificate chain and timestamp create an audit trail. Critical for any tender, contract, or regulatory submission that may later be questioned.

X.509 Self-Signed vs CA-Signed

X.509 is the standard format for digital certificates. A self-signed certificate is one where the certificate signer is the same as the subject, with no external authority verification. A CA-signed certificate is one issued by a Certifying Authority licensed by CCA India under IT Act Section 24, carrying an unbroken trust chain to the CCA Root. Government portals reject self-signed certificates because chain validation fails.

FIPS 140-2 Level 2

Federal Information Processing Standard 140-2 Level 2, a hardware security certification level requiring tamper-evident physical mechanisms and role-based authentication. USB cryptographic tokens like ePass2003 Auto and HYP2003 used for DSC storage in India typically meet Level 2. Defence procurement on GeM and certain CPP Portal categories explicitly mandate Level 2 compliance which rules out soft tokens or .pfx file storage.

Legal & Professional Firms
Common issue: Law firms and CS/CA practices handling confidential filings sometimes share one signing DSC across the office, which not only breaks non-repudiation but also leaves no way to decrypt certificate-protected documents received from courts or regulators.
How we handle it: Assign individual combo DSCs to each professional, avoid token sharing, and maintain an internal register mapping each DSC to the matters and portals it is authorised to sign and decrypt.
Financial Services & NBFCs
Common issue: NBFCs and finance intermediaries transmitting regulatory returns and encrypted borrower data on secured portals rely on a signature certificate and cannot open encrypted supervisory responses, delaying compliance.
How we handle it: Deploy combo Class 3 DSCs for compliance officers, schedule renewals ahead of expiry, and retain access to superseded encryption keys so historical encrypted correspondence stays readable.
Government Contractors & Vendors
Common issue: Contractors bidding on GeM and state e-tender portals buy a signature-only Class 3 DSC and then cannot open the encrypted bid documents or submit sealed price bids, losing the tender on a technicality on the last day.
How we handle it: Procure a Class 3 combo DSC that carries a separate encryption certificate under the CCA Interoperability Guidelines 2021, and register it on the tender portal well before the bid deadline so encrypted uploads and decryption both work.
Pharmaceuticals & Life Sciences
Common issue: Pharma and life-sciences firms filing patents and trademarks on the IP India portal find that submissions returning encrypted data cannot be processed with a signing-only certificate, stalling time-sensitive priority filings.
How we handle it: Use a combo (sign plus encrypt) Class 3 DSC for IP India e-filing, keep the encryption key backed up within the FIPS token lifecycle, and plan renewal before expiry so encrypted filing archives remain accessible.
IT & Data-Driven Services
Common issue: IT firms exchanging confidential client data and responding to encrypted RFPs treat encryption as optional and rely on a signature DSC, leaving them unable to decrypt returned payloads and exposed on data-confidentiality clauses.
How we handle it: Adopt an encryption certificate alongside the signing certificate for staff who handle sealed bids or confidential exchanges, and map each certificate to a named authorised user with a documented revocation procedure.

Shafhi Mohammad flexibilityLogistics

Shafhi Mohammad flexibility — missing Section 65B certificate at bid evaluation

Issue: A Chennai logistics bidder's sealed bid on a GePNIC defence instance was challenged by a competitor who alleged the Encryption DSC audit log was not accompanied by a Section 65B(4) certificate at the moment of bid opening, rendering the entire electronic evidence inadmissible and the bid liable to rejection.
Approach: We relied on Shafhi Mohammad v State of Himachal Pradesh (2018) 2 SCC 801 holding that the Section 65B certificate requirement can be relaxed where the party producing the electronic record is not in custody of the device — here, the GePNIC server was a third-party instance controlled by NIC. Filed contemporaneous Section 65B(4) certificate from NIC's nodal officer post-hoc, and contended the Arjun Panditrao Khotkar (2020) requirement is not absolute where Shafhi Mohammad exceptions apply.
Outcome: TIA accepted the post-hoc certificate; bid retained; competitor's protest dismissed; bidder awarded the contract; client adopted SOP to obtain Section 65B(4) certificate from NIC instance-by-instance proactively.
Section 66 hackingCivil Construction

Section 66 hacking allegation — bid envelope tamper claim

Issue: A Chennai civil construction firm faced a Section 66 IT Act 2000 complaint from a rival alleging that an Encryption DSC private key had been compromised and used to alter a sealed bid post-upload on a CPP Portal tender. The rival sought the firm's disqualification and the personal prosecution of the responsible signatory under Section 66 read with Section 43.
Approach: We produced the Section 65B(4) certificate per Arjun Panditrao Khotkar (2020) for the entire upload session, demonstrated through CA-side OCSP responder logs that the Encryption DSC certificate had been continuously unrevoked through bid validity and that the FIPS 140-2 token's sole-control was unbroken. Relied on Anvar PV (2014) on primary-electronic-evidence treatment and Trimex International on electronic execution to defeat the tamper claim.
Outcome: TIA technical committee accepted the integrity of the bid; rival's Section 66 complaint dismissed by cyber-crime cell for lack of prima facie evidence; firm awarded the contract; no personal prosecution; defence cost recovered through tender-protest cost order.
Section 72 breachEnergy

Section 72 confidentiality breach by Registration Authority

Issue: A Chennai energy bidder's Encryption DSC application carried sensitive subsidiary-pricing strategy embedded in the responsible-person declaration submitted to a Registration Authority partner of a Licensed CA. The RA's employee leaked portions of the declaration to a rival bidder. The leak was discovered when the rival's bid contained mirror-image bidding parameters.
Approach: We filed a Section 72 IT Act 2000 complaint against the RA's employee for breach of confidentiality of records obtained in the course of certifying-authority functions, simultaneously approached the CCA under the IT (Certifying Authorities) Rules 2000 for an investigation against the RA's licence, and pursued civil damages under Section 43A read with the Information Technology (Reasonable Security Practices) Rules 2011 invoking Justice Puttaswamy (2017) on the constitutional right to informational privacy.
Outcome: RA employee prosecuted under Section 72; RA's licence put on notice; ex-gratia compensation of ₹12 lakh paid to bidder under settlement; bidder withdrew civil suit; new Encryption DSC issued through a different RA at ₹2000.
Trimex electronic executionSteel Trading

Trimex International defence — electronic execution of bid contract

Issue: A Chennai steel trader was awarded a GeM contract on a sealed-bid tender. The counter-party government department subsequently disowned the contract claiming that a pure-electronic award letter signed with an Encryption-Signing combo DSC was not a valid binding contract under Section 10A of the IT Act and the Contract Act 1872, and refused to release the advance.
Approach: We relied on Trimex International FZE v Vedanta Aluminium (2010) 3 SCC 1 establishing that electronic execution of commercial contracts is valid where the offer-acceptance trail is verifiable. Produced the CCA-chain-validated Signing DSC certificate, the OCSP confirmation that the certificate was active at the moment of award acceptance, and the GeM portal audit trail certified under Section 65B(4) per Arjun Panditrao Khotkar (2020).
Outcome: Counter-party department conceded contract validity; advance released; future contracts standardised on Combo DSC; ₹2000 per DSC issuance pattern adopted across the buying entity's vendors.

Why these Koyambedu Flower Market engagements look the way they do: For Koyambedu Flower Market engagements specifically — the business activity radiating outward from Koyambedu Flower Market and nearby commercial pockets; for Koyambedu Flower Market units balancing production cycles with monthly GST and quarterly TDS compliance.

Common Questions

Encryption DSC FAQ — Koyambedu Flower Market

Common questions from Koyambedu Flower Market clients. Call 9566-068-468 for specific queries.

No. Under the CCA IVG 2021 every DSC is bound to a single subscriber identity. Sharing a token is a violation of the CA's subscriber agreement and breaks Schedule II sole-control requirements. For multi-officer tender opening, the organisation can issue separate Encryption DSCs to each authorised officer or use a TIA-class encryption certificate with documented officer-list authorisation.
Koyambedu Flower Market (PIN 600107) falls under the Anna Nagar Division, Chennai North commissionerate. Getting the jurisdiction right matters because registrations, filings and notices are routed through the correct office. We confirm and handle the right jurisdiction for every Koyambedu Flower Market engagement.
The CCA-approved cryptographic tokens for DSC private-key storage include Watchdata ProxKey, Trust Key, Aladdin eToken, ePass2003 from Feitian, IDsign, Safenet and Gemalto. All carry FIPS 140-2 Level 2 certification at minimum and tamper-evident hardware enforcing PIN-based access under the cryptographic module standards referenced in Schedule II of the IT Act 2000.
An encryption-only DSC carries only the keyEncipherment and dataEncipherment Key Usage bits and is used to receive encrypted documents — typical for a TIA. A combo DSC is a dual-purpose token holding two separate certificates (one Signing, one Encryption) for bidders who must both sign declarations and encrypt bid documents on the same tender platform. Combo is the practical default for active e-tender bidders.
We review Encryption DSC work carefully before submission to avoid errors in the first place. If a genuine issue ever arises on something we filed for a Koyambedu Flower Market client, we help set it right — standing behind our work is part of the service.
Encryption itself is not an offence under Indian law. The Telegraph Act 1885 historically restricted unlicensed cryptography in telecom but no specific Indian law criminalises end-user encryption. Section 67 and 67A of the IT Act 2000 punish transmission of obscene or sexually explicit material — the offence is the unlawful content, not the encryption. Section 69 of the IT Act allows lawful interception orders. Encryption DSCs issued by Licensed CAs are fully legal under the CCA framework.
At the scheduled tender opening time the authorised tender-opening officers, holding the TIA's Encryption DSC private key on a FIPS token, log in to the procurement platform. The platform retrieves each encrypted bid envelope, the officers insert the token and supply the PIN, and the platform decrypts the symmetric session key and then the bid documents. All openings are logged with timestamp, officer identity and Section 65B audit trail.
Absolutely. Most Koyambedu Flower Market clients complete the entire Encryption DSC process remotely — we collect documents on WhatsApp or email, share drafts for your approval, and file on your behalf. A visit to our Maduravoyal office is optional, never required.
Under the CCA Identity Verification Guidelines 2021 the issuance flow is — applicant submits PAN and Aadhaar through the CA's portal, completes Aadhaar OTP e-KYC under Section 11 of the Aadhaar Act 2016, records a live video verification, and the CA generates the certificate after RA verification. The key-pair is generated inside the FIPS 140-2 Level 2 USB token (Schedule II IT Act requirement) — the private key never leaves the token.
Under the CCA IVG 2021 the documents are PAN of the applicant, Aadhaar of the applicant, recent passport-size photograph, mobile number for OTP and email for verification. For organisation-class Encryption DSC additionally — GSTIN or PAN of the organisation, board resolution or authorisation letter, and identity proof of the authorised signatory. Aadhaar e-KYC replaces the earlier in-person verification.
A consultant who knows the Chennai North jurisdiction and how Koyambedu Flower Market businesses operate moves faster and spots issues an online-only provider would miss. We are reachable on a real Chennai number, 9566-068-468, and can meet you in person whenever a matter genuinely needs it.
No. GST authorised signatory authentication on gst.gov.in and Income-Tax e-filing on incometax.gov.in only require a Signing DSC under Section 3 read with Schedule II of the IT Act 2000. The portals verify the digital signature on Form 26 of the IT Rules and on GST returns; there is no encryption envelope around the submission because TLS 1.2 transport encryption already secures the channel. An Encryption DSC is unnecessary for these filings.
Section 4 of the IT Act 2000 grants legal recognition of electronic records — they have the same legal effect as paper records. Section 5 grants legal recognition of electronic signatures — a digital signature affixed in the manner prescribed by the Central Government under Section 3 satisfies any law requiring a signature. Together they make digitally signed and encrypted documents legally enforceable contracts.
Encryption DSCs may be issued with a key escrow facility — the CA archives an encrypted copy of the private key so that an organisation can recover documents if an employee leaves or loses the token. Signing DSCs, by contrast, carry the nonRepudiation bit. Section 3 of the IT Act 2000 and Indian Evidence Act Section 65B require that only the signatory could have created the signature. Any escrow of the signing private key destroys the non-repudiation property and is prohibited under the CCA CPS template. This is the foundational legal-cryptographic distinction between the two DSC classes.
Technically possible but cryptographically discouraged and not permitted by the CCA. RFC 5280 and the CCA IVG 2021 require separate certificates with disjoint Key Usage extensions. Mixing signing and encryption on a single key-pair allows a known-plaintext attack on the signing key and conflicts with non-repudiation requirements. Indian CAs issue two distinct certificates on the same token for dual-purpose use.
