ITR-4 presumptive — turnover crossed ₹2 crore mid-year, books retro-required

Issue: A Parry's Corner stationery wholesaler had been filing ITR-4 under Section 44AD at 8% presumptive for four straight years. In the relevant previous year his turnover crossed ₹2 crore in November due to a Pongal-season bulk order to a corporate client. Section 44AD eligibility ceases the moment turnover exceeds ₹2 crore (or ₹3 crore if 95% of receipts are non-cash). He continued cash-heavy collection through year-end so the ₹3 crore proviso did not save him — the case dropped out of presumptive entirely.
Approach: We told him to abandon ITR-4 for that year and switch to ITR-3 with regular books of account under Section 44AA. We retro-constructed the books from his manual day-book and bank statements — eight months of journal entries, debtor and creditor reconciliations, a closing stock valuation as on 31st March — and got the tax audit done under Section 44AB because the same threshold breach triggers audit. The return was filed by 31st October under the extended audit deadline, with form 3CD reporting the presumptive-to-regular transition cleanly.
Outcome: ITR-3 filed with full P&L and balance sheet; Section 44AB audit completed; declared income at actual 11.8% net margin against the presumptive 8% — paid extra ₹3.4 lakh of tax but voluntary disclosure avoided any Section 270A under-reporting penalty; client moved to permanent regular-books regime; Section 44AD presumptive door now barred for five years under sub-section (4) anyway.

Approach: We invoked the proviso to Section 139(9) requesting a 15-day extension via the e-proceedings tab, then re-filed in ITR-3 capturing the professional receipts under Section 44ADA presumptive scheme since gross receipts were within the ₹75 lakh threshold. The Section 44ADA election was supported by a covering letter explaining the inadvertent form mis-selection. We relied on the principle in Goetze (India) v CIT that a fresh claim cannot be made before the AO except by a revised return — here the curing filing was treated as the original return retrospectively.
Outcome: Defect cured on day 11 of the 15-day window; CPC processed the corrected return under Section 143(1); no penalty under Section 271F; refund of excess TDS ₹38,400 received within 6 weeks of intimation date.

AIS mismatch reconciliation through feedback mechanism

Issue: A retired bank officer received a Section 143(1)(a) prima-facie adjustment proposal flagging that AIS showed interest income of ₹4,12,000 against the ₹2,18,000 disclosed in the return. The differential of ₹1,94,000 was being proposed for addition with consequential tax demand. The taxpayer was unaware that AIS picked up matured FD interest from a discontinued branch.

Section 246A grants the right of appeal against most orders passed by the Assessing Officer to the Commissioner (Appeals). The memorandum of appeal in Form 35 must be filed within thirty days of the date of service of the order or the demand notice, whichever is later. The Commissioner (Appeals) is empowered to condone delay on sufficient cause shown. ITR-U cannot be filed to claim/enhance refund or reduce tax liability — only to disclose additional income.

Section 234A levies simple interest at 1% per month or part thereof on the tax payable on a return filed after the Section 139(1) due date. Computed from the day immediately after the due date till the actual date of furnishing the return, on the tax remaining unpaid. Section 234A is in addition to Section 234B (default in advance tax) and Section 234C (deferment of advance tax instalments) and Section 234F late fee.
Section 80E allows full deduction of interest on a loan taken from a financial institution / approved charitable institution for higher education of self, spouse, children or a student of whom the assessee is legal guardian. Available for 8 consecutive years from the year interest payment begins, or until the interest is fully paid, whichever is earlier. No upper monetary limit. Available only under the Old Regime; barred under Section 115BAC.
