Under the CCA Identity Verification Guidelines 2021 the issuance flow is — applicant submits PAN and Aadhaar through the CA's portal, completes Aadhaar OTP e-KYC under Section 11 of the Aadhaar Act 2016, records a live video verification, and the CA generates the certificate after RA verification. The key-pair is generated inside the FIPS 140-2 Level 2 USB token (Schedule II IT Act requirement) — the private key never leaves the token.
Encryption itself is not an offence under Indian law. The Telegraph Act 1885 historically restricted unlicensed cryptography in telecom but no specific Indian law criminalises end-user encryption. Section 67 and 67A of the IT Act 2000 punish transmission of obscene or sexually explicit material — the offence is the unlawful content, not the encryption. Section 69 of the IT Act allows lawful interception orders. Encryption DSCs issued by Licensed CAs are fully legal under the CCA framework.

Encrypted documents decrypted using a CCA-issued Encryption DSC and accompanied by a Section 65B certificate are admissible in court.
Section 3 of the IT Act 2000 recognises digital signatures created using asymmetric cryptosystem and hash function — this is the basis of the Signing DSC issued by Licensed Certifying Authorities. Section 3A inserted by the IT Amendment Act 2008 recognises electronic signatures, including the Aadhaar-OTP-based eSign service. eSign is a one-time short-validity signing certificate (typically 30 minutes) issued through CCA-licensed eSign service providers — it has no encryption capability and cannot be used as an Encryption DSC.
