No. eSign under Section 3A is a single-use signing-only certificate generated and revoked within 30 minutes by an eSign Service Provider such as eMudhra, NSDL or CDAC. It carries only the digitalSignature and nonRepudiation key-usage bits and has no keyEncipherment extension. Encryption requires a long-validity Class 3 Encryption DSC issued under the CCA IVG 2021 with the key-pair generated and stored on a FIPS 140-2 USB token.
Section 3 of the IT Act 2000 recognises digital signatures created using asymmetric cryptosystem and hash function — this is the basis of the Signing DSC issued by Licensed Certifying Authorities. Section 3A inserted by the IT Amendment Act 2008 recognises electronic signatures, including the Aadhaar-OTP-based eSign service. eSign is a one-time short-validity signing certificate (typically 30 minutes) issued through CCA-licensed eSign service providers — it has no encryption capability and cannot be used as an Encryption DSC.
The CCA-approved cryptographic tokens for DSC private-key storage include Watchdata ProxKey, Trust Key, Aladdin eToken, ePass2003 from Feitian, IDsign, Safenet and Gemalto. All carry FIPS 140-2 Level 2 certification at minimum and tamper-evident hardware enforcing PIN-based access under the cryptographic module standards referenced in Schedule II of the IT Act 2000.
Effective 1 January 2021 the CCA discontinued issuance of Class 2 DSCs through Office Memorandum dated 8 December 2020. From that date onwards every Encryption DSC issued in India is Class 3, which mandates in-person or paperless Aadhaar e-KYC video verification under the CCA Identity Verification Guidelines 2021. There is no Class 2 Encryption DSC available for new issuance.
