Encryption DSCs may be issued with a key escrow facility — the CA archives an encrypted copy of the private key so that an organisation can recover documents if an employee leaves or loses the token. Signing DSCs, by contrast, carry the nonRepudiation bit. Section 3 of the IT Act 2000 and Indian Evidence Act Section 65B require that only the signatory could have created the signature. Any escrow of the signing private key destroys the non-repudiation property and is prohibited under the CCA CPS template. This is the foundational legal-cryptographic distinction between the two DSC classes.
Section 65B of the Indian Evidence Act 1872 governs admissibility of electronic records as evidence. A Section 65B(4) certificate from a person responsible for the device producing the electronic record is required. The Supreme Court in Anvar PV v PK Basheer (2014) 10 SCC 473 made the certificate mandatory and Arjun Panditrao Khotkar v Kailash Kushanrao Gorantyal (2020) 7 SCC 1 reaffirmed it. Encrypted documents decrypted using a CCA-issued Encryption DSC and accompanied by a Section 65B certificate are admissible in court.
Every Licensed CA publishes a Certificate Revocation List under Section 38 of the IT Act 2000 and most also offer Online Certificate Status Protocol responders. Before a TIA decrypts a bid encrypted with its own Encryption DSC, signing software validates the bidder's Signing DSC against the CA's CRL or OCSP. A revoked certificate is rejected at the platform layer — bidders must keep their DSCs unrevoked through the bid validity period.
A dual-purpose USB token contains two separate certificates — one Signing DSC and one Encryption DSC — both linked to the same individual or organisation. For e-Tender CPP Portal upload, the bidder signs the bid letter and declarations using the Signing DSC and encrypts the bid documents using the TIA's published Encryption DSC public key. Vendors typically procure the dual-purpose token as a single FIPS 140-2 device to simplify token management.
