Signing DSCs, by contrast, carry the nonRepudiation bit. Section 3 of the IT Act 2000 and Indian Evidence Act Section 65B require that only the signatory could have created the signature. Any escrow of the signing private key destroys the non-repudiation property and is prohibited under the CCA CPS template. This is the foundational legal-cryptographic distinction between the two DSC classes.
Section 3 of the IT Act 2000 recognises digital signatures created using asymmetric cryptosystem and hash function — this is the basis of the Signing DSC issued by Licensed Certifying Authorities. Section 3A inserted by the IT Amendment Act 2008 recognises electronic signatures, including the Aadhaar-OTP-based eSign service. eSign is a one-time short-validity signing certificate (typically 30 minutes) issued through CCA-licensed eSign service providers — it has no encryption capability and cannot be used as an Encryption DSC.
