Modifications (change of address, directors, authorised signatory, bank account) are filed via the DGFT portal with applicable supporting documentation and Digital Signature Certificate of the authorised signatory.

Section 7 of FTDR Act 1992

GSP suspension and aftermath

The Generalised System of Preferences (GSP), under which the United States extended preferential tariff treatment to specified Indian exports, was suspended by the US with effect from 05-June-2019. Subsequent attempts at reinstatement have not been successful as of 2026. Indian exporters who previously relied on US-GSP have rerouted to: bilateral FTA-partner markets (UAE, Australia post-CEPA/ECTA); EU GSP (which India still accesses); and aggressive market diversification. The WTO Agreement on Trade Facilitation (TFA) entered into force on 22-February-2017 after the requisite ratification threshold was met. India ratified TFA on 22-April-2016. Issue: Leather exporter held RCMC from Council for Leather Exports valid 2019 to 2024. Client believed RCMC was perpetual once granted. On 1-April-2024 it expired. They continued to claim duty drawback at higher All Industry Rate and tried to encash MEIS legacy scrips. Customs ICEGATE flagged the drawback claim because RCMC validity check failed on the digital cross-verification. Drawback of Rs 5.8 lakh was held and MEIS legacy scrip of Rs 1.5 lakh became questionable.
Approach: RCMC validity is 5 years from issue, renewable. Filed fresh RCMC application with CLE attaching last 3 years export performance certificate from CA, audited financials, IEC copy, and membership fee of Rs 22000. Got fresh RCMC in 14 days, valid 2024 to 2029. For the held drawback, filed a representation to JC Customs citing CBIC Circular that drawback once accrued cannot be denied for procedural lapse during validity gap if the export itself happened during RCMC-valid period. We had to prove each shipping bill was during the prior RCMC validity. MEIS legacy is a separate fight, that scheme closed in 2020 and the scrips have their own validity.
Outcome: RCMC renewed in 14 days, drawback of Rs 5.8 lakh released after 38-day representation cycle. MEIS scrip of Rs 1.5 lakh utilised within its own expiry. Client now gets a 90-day-before-expiry email reminder from my office for every export council membership.

EPCG export obligation default after 6 years triggered customs duty recovery of Rs 32 lakh

Issue: Client imported a high-speed offset press under EPCG scheme in October 2018 saving Rs 32 lakh in basic customs duty against an export obligation of 6 times duty saved over 6 years, i.e. Rs 1.92 crore in eligible exports by October 2024. By October 2024 they had completed only 64 percent of EO due to a buyer cancellation in 2022. DGFT issued show cause notice in December 2024 demanding full customs duty plus 15 percent simple interest, total Rs 51.8 lakh.
Approach: Filed EO discharge application showing the actual exports done, requested extension under Para 5.17 of Foreign Trade Policy citing buyer cancellation as bona fide ground. Attached communication trail with cancelled buyer, alternate buyer development efforts, and revised business plan. Composition fee of 10 percent of unfulfilled portion of duty saved was Rs 1.15 lakh. In parallel pushed for completing balance EO in next 18 months by re-targeting Bangladesh and Sri Lanka markets. The composition route is cleaner than litigation because customs duty recovery includes interest which compounds the loss.
Outcome: EPCG extension granted for 18 months on payment of composition fee of Rs 1.15 lakh. Balance EO completed in 14 months with export of Rs 78 lakh to South Asian markets. Final discharge certificate received in 19 months. Saved Rs 50 lakh in adverse outcome.

Advance Authorization input-output norms breach at customs assessment cost Rs 8.7 lakh

Issue: Auto component exporter held Advance Authorization for duty-free import of steel coils against export of stamped parts. Standard Input Output Norms specified yield of 78 percent. Client's actual yield in FY 2024-25 was 71 percent due to material quality issues. The 7 percent gap meant they had imported 9 percent more steel than was needed for the actual exports. Customs at the time of EO closure flagged this and proposed to recover customs duty on the excess input.
Approach: Two options under Foreign Trade Policy. Option 1: pay customs duty plus interest on the excess input. Option 2: re-export the unutilised input or its equivalent value. We computed both. Option 1 came to Rs 8.7 lakh duty plus Rs 1.4 lakh interest. Option 2 was operationally hard because the steel was already partially used. Negotiated under Para 4.49 for SION ratification with attached engineering report from a CET-recognised lab certifying the actual yield. DGFT Norms Committee accepts ratification if backed by lab test for sectors where yield variance is technical. Lab report cost Rs 65000 and took 28 days.
Outcome: Norms ratified at 72 percent retroactively for the authorisation. Customs duty exposure dropped to Rs 1.8 lakh on residual variance, paid voluntarily to close. Avoided Rs 8.3 lakh of avoidable cost. Lab certification process now part of onboarding for any AA-using client.

Star Export House status lost on biennial review, lost MEIS legacy benefits and L-1 customs scheme

Issue: Seafood exporter was recognised as Two Star Export House since 2021 with FOB performance of USD 26 million across 3 preceding years. On biennial review in 2025 DGFT recomputed performance and found USD 19 million only across 2022-23, 2023-24 due to a Covid-period weak year being included. Two Star threshold is USD 25 million. They were downgraded to One Star losing privileges including faster customs clearance under L-1 scheme and lounge facility at certain DGFT offices.
Approach: Reviewed the export realisation in EDPMS for the 4 immediately preceding years. Identified that one large invoice of USD 1.8 million had been wrongly tagged to 2021-22 instead of 2022-23 due to bill of lading date mismatch with realisation date. Filed correction with the AD Bank to retag the BRC to the correct year. Once EDPMS reflected the correction, filed a review application with DGFT for Star Export House status, attaching the rectified BRC and a CA certificate cross-referencing each shipping bill, FIRC, and BRC. This is a documentation-heavy fight, not a legal one.
Outcome: Two Star status restored after 47 days of review. L-1 scheme benefit and faster clearance reinstated. The bigger lesson: review BRC tagging on EDPMS every quarter, not just at biennial Star review time. Bank often gets year-tagging wrong on cross-year realisations.

Rebate of State and Central Taxes and Levies (RoSCTL) is a parallel remission scheme exclusively for apparel and made-ups under Chapters 61, 62 and 63 of the ITC(HS). ICEGATE (Indian Customs and Central Excise Electronic Commerce / EDI Gateway) is the CBIC portal at icegate.gov.in for filing shipping bills, bills of entry and accessing customs data. Exporters and importers register on ICEGATE with their IEC, DSC and AD Code. ICEGATE registration is required to track shipments, claim IGST refunds and access bond / drawback ledgers.
Section 7 of the FT(D&R) Act 1992 read with Para 2.05 of the Foreign Trade Policy 2023 (effective 1-Apr-2023) mandates IEC for every person undertaking import or export of goods. Service exporters technically need IEC only when they wish to claim benefits under FTP — but virtually every AD bank, payment aggregator and customs broker insists on a live IEC for any inward foreign-currency receipt or outward remittance.
Authorised Dealer (AD) Code is the 14-digit code of the exporter's bank branch authorised by RBI to deal in foreign exchange. Under CBIC instructions and the Customs EDI procedure, the AD Code must be one-time registered at every Customs port from where the exporter intends to ship. Without AD Code mapping at a port, no shipping bill can be filed and no IGST refund can be auto-disbursed at that port.
