What is FSSAI registration and which tier applies

Turnover-based State Licence threshold

Where the FBO does not fall in any of the mandatory Central categories, the choice between Basic Registration, State Licence and Central Licence is driven by aggregate annual turnover computed at PAN-India level. Turnover up to twelve lakh attracts Form A Basic Registration; turnover from twelve lakh to twenty crore attracts Form B State Licence; turnover above twenty crore attracts Form B Central Licence. The aggregate turnover is computed on the financial-year basis ending 31 March. Mid-year crossing of a threshold triggers an obligation to upgrade within thirty days under Regulation 2.1.2(2). Failure to upgrade is treated as operating without correct licence and attracts Section 63 of the FSS Act.

Voluntary upgrade and group-entity structuring

Many FBOs voluntarily obtain a State Licence even when below the twelve-lakh threshold because aggregator platforms, e-commerce marketplaces and institutional buyers increasingly insist on State Licence as minimum tier. Voluntary upgrade does not, however, allow the FBO to evade the Central Licence threshold if capacity or category triggers it. Group-entity structuring — where a holding company holds the licence and operating subsidiaries handle distribution — must align with the legal definition of FBO under Section 3(1)(j) of the FSS Act, which is premises-specific. Each premises requires its own licence even if owned by the same legal entity.

Statutory framework under the FSS Act 2006

FSSAI registration in India is governed by the Food Safety and Standards Act 2006, which consolidated eight pre-existing food laws including the Prevention of Food Adulteration Act 1954, the Fruit Products Order 1955, the Milk and Milk Products Order 1992, the Vegetable Oil Products (Control) Order 1947 and others. Section 31(1) of the FSS Act mandates that no person shall commence or carry on any food business except under a licence or registration granted under the Act. The Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations 2011 operationalise this requirement and prescribe three tiers — Basic Registration for annual turnover up to twelve lakh, State Licence for turnover from twelve lakh to twenty crore, and Central Licence for turnover above twenty crore or for specified categories regardless of turnover. The 14-digit FSSAI Licence Number scheme codifies the licensing authority, year of issue and unique premises identifier and must be displayed prominently per Regulation 2.2.2(9) of the Packaging and Labelling Regulations 2011.

Import and export food safety regulation

Imported food labelling and rejection

Imported food must comply with FSS Packaging and Labelling Regulations 2011 in addition to the standards prescribed under the FSS (Food Products Standards) Regulations 2011 for the specific product category. Where the original label is not in English or Hindi or does not contain mandatory declarations, the importer must affix a translated sticker in the customs-bonded warehouse before clearance. Where the consignment fails laboratory testing, options are (a) re-export within thirty days at importer's cost, (b) destruction under FSAI supervision, or (c) appeal under Regulation 13 within fifteen days for re-test at a different Referral Lab. Repeated rejection of importer's consignments triggers risk-based intensified sampling.

Export compliance and importing-country standards

Food exporters must hold a Central Licence (mandatory under Schedule 1 Part III). The Central Licence number is endorsed on the export-oriented invoice and on the EIC/EIA health certificate where required by the importing country. EU-bound exports must additionally comply with EU Regulation 178/2002 General Food Law including Article 18 traceability — one-step-back, one-step-forward — and EU contaminants Regulation 2023/915. US-bound exports require the manufacturing facility to register under FSMA 2011 Section 415 with FDA and to maintain a Foreign Supplier Verification Programme partner in the US. Each importing country has its own positive list and MRL framework which must be cross-referenced before consignment dispatch.

Codex Alimentarius and the international standards-setting role

Codex Alimentarius Commission, jointly administered by FAO and WHO since 1963, sets international food safety and quality standards. Section 16(1)(d) of the FSS Act 2006 obliges FSSAI to harmonise Indian food standards with international standards including Codex. The Joint FAO/WHO Expert Committee on Food Additives (JECFA) provides scientific risk assessment for food additives, contaminants and residues, and FSSAI Scientific Panels rely on JECFA evaluations under Regulation 4 of the FSS (Scientific Panel) Regulations 2009. The WHO Global Strategy for Food Safety 2022-2030 provides the over-arching framework that India implements through FSSAI standard-setting and FoSCoS-based regulatory action.

Inspection, sampling and enforcement

Food Safety Officer powers under Section 38

Section 38 of the FSS Act 2006 vests the Food Safety Officer with powers of inspection, sampling, seizure and prohibition order. The FSO may enter any food business premises at reasonable hours, inspect records, draw food samples in the prescribed manner under Section 47, seize stock where contravention is suspected, and issue an improvement notice under Section 32. Sampling under Section 47 must be in quadruplicate — one part for analysis at the Notified Food Laboratory, one part retained by the FBO, one part for re-analysis if disputed, one part deposited with the Designated Officer. Refusal to allow inspection attracts Section 61 penalty.

Laboratory analysis and dispute resolution

The sample drawn under Section 47 is analysed at a Notified Food Laboratory under Section 43, accredited by NABL and notified by FSSAI. The Food Analyst issues a report under Form III declaring the sample as standard, sub-standard, misbranded, unsafe or otherwise. Where the FBO disputes the report, it may apply within thirty days under Section 46(4) for re-analysis at a Referral Food Laboratory of higher standing. The re-analysis report is final. The 2022 expansion of FSSAI's mobile food testing labs (Food Safety on Wheels) brought on-the-spot testing to area-based inspection drives, with confirmatory testing routed to fixed labs.

Improvement notice and Section 32 procedure

Where the Designated Officer is satisfied that an FBO has contravened the FSS Act in a manner that does not warrant immediate prosecution, Section 32 empowers the issue of an improvement notice specifying the contravention and the period within which it must be rectified (typically fourteen days, not less than seven). Failure to comply with improvement notice attracts Section 60 penalty — imprisonment up to six months and fine up to two lakh. Continuing non-compliance further entitles the Designated Officer to suspend or cancel the licence under Section 32 read with Regulation 2.1.5(4). The FBO has the right of appeal to the Commissioner of Food Safety.

Recall, traceability and crisis management

Insurance and product-liability coverage

While not statutorily mandated under the FSS Act, product-liability insurance is increasingly contracted by FBOs to cover the cost of recall, consumer compensation under Section 65 and Consumer Protection Act 2019 claims, and crisis-management communications. The Consumer Protection Act 2019 introduced product-liability claims for unsafe products including food under Sections 82 to 87, with strict liability on the manufacturer for a defective product. The convergence of FSS Act Section 65 compensation and Consumer Protection Act product-liability creates a meaningful financial exposure that risk-managed FBOs cover through specialty insurance.

FSS (Food Recall Procedure) Regulations 2017

The Food Safety and Standards (Food Recall Procedure) Regulations 2017 mandate that every State and Central Licensee maintain a documented recall plan that can be activated within twenty-four hours of identification of unsafe food in the market. The Regulations distinguish Class I recall (immediate health hazard, full market withdrawal), Class II recall (potential health hazard, traceable lot withdrawal) and Class III recall (regulatory non-compliance without health risk, voluntary correction). The FBO must notify FSSAI within twenty-four hours of initiating a recall and submit progress reports until completion. Failure to initiate timely recall attracts Section 28 penalty and aggravates the underlying offence.

Traceability — one-step-back, one-step-forward

Schedule 4 of the Licensing Regulations 2011, and the Food Recall Procedure Regulations 2017, require every FBO to implement one-step-back, one-step-forward traceability — that is, every consignment received must be traceable to the immediate supplier and every consignment dispatched to the immediate buyer, by batch and lot number. The principle is aligned to EU Regulation 178/2002 Article 18. Documentation must be retained for the shelf life of the product plus at least two years. Modern FBOs increasingly implement digital traceability using QR codes, GS1 barcodes and blockchain solutions, though paper-based registers remain compliant where digital is not feasible.

How the local trade mix shapes this — In Madhavaram Milk Colony, where dairy businesses dominate the local compliance profile; the cluster of dairy, cold storage, logistics businesses that defines Madhavaram Milk Colony's commercial fabric.

Food Business Operators (Trade)
Common issue: Distributors, wholesalers and re-labellers treating themselves as pure traders sometimes register under Basic Registration even when storage and handling capacity exceeds the State threshold. Regulation 2.1.1 categorises wholesalers turning over twelve lakh to thirty crore under State Licence and above thirty crore under Central Licence. Mis-classification leads to refusal of import-export code linkage and bank rejection of working-capital limits.
How we handle it: Compute aggregate trade turnover on a PAN-India basis as per Regulation 1.2.1(1) interpretation by FoSCoS. File Form B with the State Licensing Authority. Where the FBO repacks or re-labels under its own brand, additionally comply with the Packaging and Labelling Regulations 2011 — the brand-owner becomes the legal manufacturer under Section 3(1)(zf) of the FSS Act.
Food Exporters
Common issue: Food exporters are required to obtain a Central Licence under Schedule 1, Part III, Sl. No. 17 of the Licensing Regulations 2011 regardless of turnover. Many exporters proceed on State Licence on the strength of APEDA registration and only realise the gap when the importing country's competent authority demands an FSSAI Central Licence number on the health certificate or when EIC/EIA refuses to issue Certificate of Origin endorsements.
How we handle it: File Form B with Central Licensing Authority at the time of incorporation if export is contemplated. The Central Licence number must appear on the export-oriented invoice and on the Export Inspection Council health certificate. For EU-bound exports, align labelling and traceability to EU Regulation 178/2002 Article 18 one-step-back-one-step-forward traceability, and for US-bound exports register the facility under FSMA 2011 Section 415 with FDA in parallel.
E-Commerce Food Sellers
Common issue: Direct-to-consumer e-commerce food sellers operating through Amazon, Flipkart and own websites often hold only a Basic Registration tied to a residential address. FSS (Licensing and Registration) Regulations 2011, Regulation 2.1.1(4), read with FSSAI Advisory dated 02.02.2017, requires every e-commerce FBO to hold at least a State Licence and to display the licence number on every product listing. Marketplaces are now under MoU with FSSAI to verify licences at the SKU level.
How we handle it: Obtain a State Licence for the warehouse from which dispatch occurs; if dispatch happens from multiple states, obtain separate licences per dispatch state. Upload the licence to seller central catalogue. The brand owner, importer or seller-on-record assumes the legal-manufacturer obligation under Section 3(1)(zf), including labelling, batch coding and recall.
Milk Procurement Cooperatives
Common issue: Village-level dairy cooperatives and bulk milk coolers procuring from farmers often treat themselves as primary producers exempt from licensing under Section 31(11) of the FSS Act read with Regulation 2.1.2(5). The exemption, however, applies only to primary food production at farm gate; once milk is chilled, transported and consolidated above the per-day threshold, the chilling unit becomes a manufacturing premises requiring State or Central Licence depending on capacity.
How we handle it: Where the daily chilling capacity exceeds five hundred but is under fifty thousand litres, file Form B for State Licence; above fifty thousand litres, file for Central Licence. The cooperative society document, MILMA-style by-laws and society registration certificate are acceptable proof of constitution under FoSCoS document requirements.
Bakery and Confectionery
Common issue: Bakery and confectionery operators including bread, cakes, biscuits and chocolate makers frequently overlook that bakery production above one hundred kilograms per day attracts State Licence, and above two metric tonnes per day attracts Central Licence under Schedule 1, Part III. Sugar-coated and chocolate-coated confectionery additionally falls under FSS (Food Products Standards) Regulations 2011 Part 2.7 with limits on artificial sweeteners and colours.
How we handle it: Compute total daily production capacity across all SKUs, not per-SKU. File Form B for the correct tier. Maintain a recipe log with INS-numbered additives within the limits set by FSS (Food Additives) Regulations and Codex GSFA. For exports, additionally verify that artificial colours used comply with the importing country's positive list.

Storage operationsCold Storage

Cold storage facility licensed under Central

Issue: A cold storage operator running 12,000 MT capacity primarily for frozen meat and fish products operated under a State Licence. Schedule 1 read with Regulation 2.1.1 places storage units (including cold/refrigerated/non-refrigerated) with capacity above 10,000 MT per annum under Central Licensing. A meat-export client's audit by Export Inspection Council flagged the State-Central mismatch.
Approach: Filed Form B Central License declaring all 12,000 MT capacity in five storage chambers, attached chamber-wise temperature mapping, refrigeration log, FSMS plan, water-source test, and storage-category code per FSSAI Storage Annexure. Coordinated EIC follow-up audit once Central Licence was issued.
Outcome: Central Licence granted in 38 days; meat exporter's audit closed with no observation; cold storage onboarded as approved storage point in two more export channels.

Schedule 4 audit failure — FSMS plan was a template copy with wrong CCPs

Issue: Third-party Schedule 4 audit (mandatory for high-risk food categories) failed because the FSMS plan submitted with Central License application was a generic template — the Critical Control Points listed were for dairy when the unit processed millets. Auditor flagged 14 non-conformities. Designated Officer issued a 30-day cure notice failing which license suspension under Section 32 was on the table.
Approach: Rebuilt the FSMS plan ground-up with a HACCP consultant. Mapped actual process flow — receiving, cleaning, hulling, sorting, packing — and identified 4 genuine CCPs with critical limits and monitoring frequencies. Trained the Food Safety Supervisor through FoSTaC level-2 certification. Re-ran the audit in 26 days with all 14 NCs closed. Submitted closure report with corrective and preventive action evidence.
Outcome: License retained — no suspension. Audit closure cost ₹85,000 including HACCP consultant fee and FoSTaC training for 3 staff. Now treating FSMS as the bedrock of every Central License application rather than a templated attachment.

FSO surprise inspection — Section 31(2) lab certificate missing for 11 months

Issue: Food Safety Officer conducted a surprise inspection during festival season. Asked for the 6-monthly water testing certificate and the annual product testing certificate under Section 31(2). Client had neither — operating on State License for 14 months with zero lab reports on file. FSO collected sample on the spot and issued a Section 32 improvement notice with 14-day cure deadline.
Approach: Booked sample testing at an NABL-accredited lab within 48 hours — water, oil quality, and 3 representative finished products. Reports came back in 9 days, all within FSSR limits. Submitted to FSO with a self-declaration explaining oversight and a written periodic-testing calendar going forward. Drafted a sample collection SOP — quarterly water, half-yearly oil, annual product mix — with vendor lab on standing instructions.
Outcome: Improvement notice closed without prosecution. ₹12,000 compounding. Saved client from Section 49 penalty (₹2L cap) and possible name in the FSO's quarterly defaulter list. Lab-test calendar now standard for every State and Central License client.
premises_proof_disputeFirst-time FBO / small restaurant

Premises ownership proof rejected 4 times — rent agreement vs NOC tussle

Issue: First-time FBO had a rented kitchen with an 11-month rent agreement on plain paper, no NOC from landlord for food business use. FoSCoS rejected the State License application four times across two months — first for unstamped agreement, then no landlord NOC, then mismatch in address spelling, finally for absence of khata/property tax receipt to establish landlord ownership. Client losing pre-revenue rent of ₹45,000 per month.
Approach: Executed a fresh 33-month rent agreement on ₹500 stamp paper with explicit food-business-permitted clause. Obtained notarised NOC from landlord with photo ID and ownership document. Pulled property tax receipt for current year. Address spelling reconciled between Aadhaar, electricity bill, agreement, and FoSCoS form letter-by-letter. Resubmitted as a fresh application with all premises documents bundled.
Outcome: License issued in 19 days on the fifth attempt — 81 days total elapsed from first attempt. Avoided ₹1.35L in rent burn that would have come from another month's delay. Now using a single premises-proof checklist for every new FBO onboarding to prevent rejection cycles.

FSSAI FAQ — Madhavaram Milk Colony

Common questions from Madhavaram Milk Colony clients. Call 9566-068-468 for specific queries.

Yes. Under FSSAI Direction F.No.15(31)2017/E-Comm/RCD dated 2 February 2018 and the FSS (Licensing and Registration) Amendment Regulations 2018, all e-commerce food business operators including aggregators and cloud kitchens with multi-state operations require Central Licence. The platform must also list FSSAI numbers of all listed restaurants on the consumer interface.
Section 63 of the FSS Act 2006 provides that any person required to obtain a licence who manufactures, sells, distributes, imports or otherwise transacts in any article of food without licence shall be punishable with imprisonment for a term which may extend to six months and with fine which may extend to ₹5 lakh.
Turnaround depends on the service and how quickly you share documents. Once we have a complete set, FSSAI for Madhavaram Milk Colony clients moves without avoidable delay, and we keep you posted at each stage. We give a realistic timeline upfront rather than an optimistic one.
Yes. Under Regulation 2.6.1 of the FSS (Packaging and Labelling) Regulations 2011 read with Regulation 2.4 of the FSS (Labelling and Display) Regulations 2020, every package of food must bear the FSSAI logo and 14-digit licence/registration number. Failure attracts misbranding penalty up to ₹3 lakh under Section 52 read with Section 53.
Renewal application filed within 90 days after expiry attracts a late fee of ₹100 per day of delay under the FSS (Licensing and Registration) Amendment Regulations 2021. After 90 days the licence is treated as expired — no renewal is permitted and a fresh application with full fee is required, with intervening operations exposing the FBO to Section 63 penalty.
Call or WhatsApp 9566-068-468 with a one-line description of your requirement. We confirm exactly which documents your Madhavaram Milk Colony case needs, share a fixed quote upfront, and start once you approve. The first discussion is free.
A Central Licence in Form B is mandatory under Regulation 2.1.3 where annual turnover exceeds ₹20 crore, where the FBO operates in two or more States, for all importers and exporters, all e-commerce food business operators, 5-star and above hotels, units in port, airport or SEZ, all Central Government establishments, dairies above 50000 LPD, vegetable oil units above 2 MT/day, meat units above the State threshold, and any food business notified by the Central Licensing Authority.
Under Regulation 2.1.7 read with the FSS (Licensing and Registration) Amendment Regulations 2021, renewal must be applied at least 30 days before expiry through FoSCoS in Form A or Form B as applicable. Renewal applied within 90 days after expiry attracts a late fee of ₹100 per day. Beyond 90 days the licence is treated as expired and a fresh application is required.
Absolutely. Most Madhavaram Milk Colony clients complete the entire FSSAI process remotely — we collect documents on WhatsApp or email, share drafts for your approval, and file on your behalf. A visit to our Maduravoyal office is optional, never required.
Basic Registration in Form A is for petty FBOs with annual turnover not exceeding ₹12 lakh under Regulation 2.1.1. This covers small retailers, hawkers, itinerant vendors, temporary stall holders, small or cottage food units producing up to 100 kg/litre per day, milk handlers up to 500 LPD, and small slaughter units up to 2 large or 10 small animals or 50 poultry birds per day.
Form D-1 is the annual return prescribed under Regulation 2.1.13(1) for every licensed FBO that is engaged in manufacturing or importing of food. It captures category-wise quantity manufactured, sold and exported in the financial year. The due date is 31 May following the close of the financial year.
Not sure whether FSSAI applies to you? Call 9566-068-468 and describe your situation — we will tell you plainly whether you need it, when, and what it involves, before you spend anything. Many Madhavaram Milk Colony enquiries start exactly this way.
FoSCoS — Food Safety Compliance System at foscos.fssai.gov.in — is the unified online portal launched in June 2020 replacing the legacy FLRS system. All FSSAI applications for new registration, licence, modification, renewal, annual return Form D-1 and product approval are filed through FoSCoS using PAN-based or Aadhaar-based login.
Form D-2 is the half-yearly return prescribed under Regulation 2.1.13(2) exclusively for FBOs manufacturing milk and milk products. It is filed twice a year — by 31 October for April-September and by 30 April for October-March — capturing quantity of milk procured and products manufactured.
Form A application along with passport-size photograph of the FBO/proprietor/partner/director, government photo ID (Aadhaar/PAN/voter ID/passport/driving licence), address proof of the business premises (EB bill, property tax receipt or rent agreement with owner NoC), and a self-declaration of food safety as prescribed in Schedule 4 Part I.
Under Regulation 2.1.5(2) any modification of particulars in the licence — change in name, address, food category, partner/director, capacity — must be applied through FoSCoS. Modification involving change of premises or major capacity expansion requires fresh application; minor changes are processed as endorsement after fee payment.
